1. Scope

These Terms of Use apply to all users of the Koticharge.com website and the KotiCharge smartphone application. The Terms of Use define the rights and obligations regarding the use of the service.
If you do not agree to these Terms of Use, you must not use our aforementioned services.

These Terms of Use sometimes refer to “Housing Company Users” in certain sections. Housing Company Users are users of the KotiCharge application who use a charging device operated by KotiCharge in a housing company that has an operating agreement with KotiCharge.

2. Use of Services

KotiCharge provides electric vehicle charging services through its operated charging points. The availability of services may vary due to factors beyond KotiCharge’s control, such as network connectivity, the functionality of charging devices, and other circumstances.

3. Payments

The current charging prices are visible in the KotiCharge application. In addition, KotiCharge charges monthly service fees, the pricing of which may have been agreed with the housing company. By using the application, the user accepts these fees.

The payment method in the application is a payment card linked to the user account, in addition to which a paid charging transaction can be initiated with an RFID card linked to the user account. The user is responsible for ensuring that the card has sufficient funds to pay for charging transactions. KotiCharge may place a pre-authorization on the user’s payment card.

All payment transactions within the application are managed by Stripe, inc. KotiCharge does not store users’ payment card information. In addition to charging transactions, all fees, such as idle and service fees, are charged to the user’s payment card.

KotiCharge charges a billing surcharge to all users who have active charging transactions during the month. The billing surcharge is charged in connection with the payment of charging transactions. The billing surcharge varies from €0.5 to €1 depending on the device’s operating agreement. At public charging points, the billing surcharge is €0.5.

When a housing company user uses the service, he accepts the service and electricity pricing agreed between KotiCharge and the housing company. When a user charges at a charging point operated by KotiCharge in a housing company, he becomes a subscriber to the operating service.

Housing company users pay KotiCharge a monthly operating subscription fee. You can terminate the use of the operating service and the subscription fee by contacting KotiCharge’s customer service. The notice period is 1 month.

KotiCharge is responsible for ensuring that the service fees comply with the price list agreed with the housing company.

4. User Responsibility

The user is responsible for ensuring that their vehicle is compatible with KotiCharge’s services.
The user must review and accept the pricing of the charging station before initiating a charging session.
Misuse of services may result in the suspension of the user’s account.

5. Liability and Warranties

KotiCharge provides its services “as is” without any guarantees of functionality or error-free operation. KotiCharge is not liable for any damages caused by service interruptions, third-party actions, or misuse, except where Finnish law dictates otherwise.

6. Access Restriction

KotiCharge reserves the right to deny access to its services for users who do not comply with these terms or otherwise cause harm to KotiCharge.

7. Data Protection

The KotiCharge application and website are subject to KotiCharge’s Privacy Policy, which defines how personal data is processed, stored, protected, and used.

8. Dispute Resolution

Users must first contact KotiCharge customer support in case of disputes or issues. If a resolution cannot be reached, disputes will primarily be handled by Finnish courts.

9. Governing Law

These terms and the use of KotiCharge services are governed by Finnish and EU laws, regulations, and statutes.
